Der Begriff der privaten Depotverwaltung kennzeichnet den Bereich der bankunabhängigen Effektenverwaltung, der in einer Zeit wachsender Vermögensbildung an Bedeutung gewinnt. Der Verfasser entwickelt für den privaten Depotverwalter ein Pflichtenmodell, das neben einer praxisorientierten Fallgruppenbildung pflichtwidrigen Verhaltens auch Erkenntnisse wirtschaftswissenschaftlicher Kapitalmarktforschung einbezieht. Er leitet hierbei die Sorgfaltspflichten des privaten Depotverwalters aus der Interessenwahrungspflicht des Verwaltungsvertrags ab, nicht aber aus dem in der Literatur so genannten Anlegerschutzprinzip, das nach seiner Meinung auf eine Rolle als rechtsethisches Postulat beschränkt bleiben sollte.
