The ordoliberal school of competition thought is a distinct linguistic community whose conceptual and semantic influence extended far beyond Germany and eventually shaped the European legal order. Linguistic misunderstandings still impacted the negotiations of the founding European Treaties, but in the subsequent application of the new rules, the Freiburg School’s ordoliberal ideas gained in popularity. In the early 2000s, this ordoliberal language was replaced by neoliberal concepts borrowed from the Chicago School. The study combines archival materials, oral history interviews, case law and Text Mining methods. In doing so, it contributes to the historiography of EU competition law, the post-war history of ordoliberalism, and methodological debates about Digital Humanities.

Am 20. September 2013 fand zu Ehren des 70. Geburtstags von Prof. Dr. Günter Hager an der Albert-Ludwigs-Universität Freiburg ein Symposium unter dem Titel „Fuchs oder Igel? – Fall und System in Recht und Wissenschaft“ statt. In Anlehnung an das Versfragment des Dichters Archilochos, „Der Fuchs weiß viele Dinge, aber der Igel weiß ein großes Ding.“, ging die Veranstaltung der Frage nach, in welchem Verhältnis das Falldenken – gleichsam verkörpert durch den Fuchs – und das Systemdenken – gleichsam verkörpert durch den Igel – in Recht und Wissenschaft stehen. Dieser Band dokumentiert die auf dem Symposium gehaltenen Referate, die sich dem Thema anhand ausgewählter Facetten näherten, sowie die Diskussionen zu den Beiträgen.

Günter Hager thematisiert die Strukturen des heutigen Privatrechts in Europa. Dazu zieht er das deutsche, englische und französische Recht heran. Die Konstitutionalisierung und die Europäisierung des Privatrechts berücksichtigt er ebenso. Das erste Kapitel ist den Leitideen des Privatrechts gewidmet. Günter Hager stellt das auf die Abgrenzung von Freiheitssphären gerichtete formale und das auf die Durchsetzung von Werten gerichtete materialisierte Recht einander gegenüber. Das zweite Kapitel ist der Rechtsprechungspraxis gewidmet. Günter Hager bespricht grundlegende neuere Entscheidungen zu Fragen des Vertrags- und des Deliktsrechts. Ausgehend von der Einsicht, dass Fallrecht eine immer größere Rolle spielen wird, diskutiert er im dritten Kapitel die Prinzipien einer Theorie des Fallrechts. Im Mittelpunkt stehen die Topoi der Rechtsfindung. Eine besondere Rolle spielt hierbei der Gedanke der Verantwortung.
